Arranging Child Custody / Visitation
Although child custody / visitation arrangements take a variety of factors into consideration, the child's best interest is the most important consideration. The court is concerned with raising children in the healthiest way possible, and this often means giving both parents time with the child.
In most situations, I encourage my clients to use the family court service mediation. Every family has unique factors that must be taken into consideration when child custody is being determined, and mediation gives families the flexibility they need to accommodate their situation. I prepare my clients for mediation, helping them understand the expectations and processes of mediation.
Determining Child Support and Spousal Support Amounts
In California, child support amounts are determined by the California Guidelines, an algebraic equation is used by the courts. Although there is little deviation from the formula, it is important to work with an attorney to help establish that all income is properly considered when support amounts are being determined and that appropriate deductions are considered.
Spousal Support
There are two types of spousal support: temporary and long-term spousal support.
Temporary spousal support may be ordered in any amount based upon one party's needs and the other party's ability to pay. The court may look at the factors in the California Statutes to determine if temporary support is needed.
Long-term spousal support or permanent spousal support is contained in a judgment for dissolution (divorce) or judgment of legal separation the amount and duration is ordered by the judge or agreed to by the parties (stipulated to).
Modifying Child Custody and Child Support Arrangements
Although the child support and custody arrangements may be appropriate when they are first created, changes in circumstance can make a modification necessary. A pay cut or pay raise, loss of job and relocation can influence guidelines.
